1. Introduction
Welcome to OpenResourceConcourse ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at openresourceconcourse.sbs (the "Service") operated by OpenResourceConcourse.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
OpenResourceConcourse offers luxury yacht charter services, which include but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is subject to certain conditions like weather, and we reserve the right to change or cancel services when necessary.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you must:
- Be at least 18 years old
- Provide truthful and complete details
- Make the necessary deposit as mentioned in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Booking confirmation is subject to payment receipt and our written agreement. We have the discretion to refuse service to anyone.
3.3 Availability
Charters depend on yacht availability and suitable climate conditions. We aim to accommodate your requested dates to the best of our ability.
4. Payment Terms
4.1 Pricing
All fees are in € and include applicable taxes unless stated otherwise. Pricing can change without prior notice.
4.2 Payment Schedule
- Deposit: Half the total cost of the charter due at the time of reservation
- Final payment: Due two days prior to the charter departure
- Incidental expenses (if applicable): Payable after the charter concludes
4.3 Payment Methods
Accepted payment methods include major credit cards, bank wires, and certified cheques. All transactions are processed using secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancellation occurs over 72 hours before departure: You're eligible for a full refund minus transaction fees
- If cancellation happens 24-72 hours before departure: You're entitled to a 50% refund
- If cancellation is less than 24 hours before departure: No refund is available
5.2 Weather Cancellations
For cancellations due to unsafe weather as determined by our captain, we will propose to:
- Reschedule the charter to an alternative date at no extra cost
- Issue a full refund if we can’t reschedule
5.3 Mechanical Issues
In case there are mechanical difficulties with the designated yacht, we will try to provide an appropriate substitute. If we cannot provide a replacement, a complete refund will be given.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to all directives given by the crew
- Use the provided safety gear as necessary
- Inform about any medical conditions that could affect their well-being
- Stay within designated regions on the vessel
6.2 Prohibited Items
The following items are not allowed on board:
- Glass containers
- Illegal substances
- Firearms or other weapons
- Excessive amounts of beverages
- Animals (unless prior approval is obtained)
6.3 Conduct
Passengers should behave in a respectful and proper manner. We reserve the right to terminate a charter without a refund if the behavior of any passenger constitutes a safety threat or is substantially disrupting others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the cost paid for your charter. We will not be responsible for:
- Personal injuries due to your negligence
- Loss or damage to your belongings
- Any indirect, consequential, or punitive damages
- Delays due to weather or other uncontrollable circumstances
7.2 Insurance Coverage
We have comprehensive maritime insurance for our vessels and operations. You are accountable for securing your travel and personal insurance needs.
7.3 Assumption of Risk
By taking part in our yacht services, you recognize that boating activities inherently carry risks, and you accept responsibility for your own safety and actions.
8. Modifications and Itinerary Changes
We reserve the right to alter itineraries, paths, or schedules in response to weather, safety, or operational necessities. We will try to ensure the alternatives are comparable.
9. Force Majeure
We shall not be liable for any alterations, delays, or cancellations brought about by events beyond our control, which might occur but are not limited to:
- Extreme weather
- Natural disasters
- Legislative actions
- Harbor closures
- Equipment malfunctions
10. Privacy and Data Protection
Your private data is processed following our Privacy Policy. Using our services means you consent to the collection and use of your information as outlined in the Privacy Policy.
11. Intellectual Property
All materials on our website, such as texts, images, logos, and graphics, are protected by copyright and trademark laws. Reproducing, distributing, or creating derivative works without prior consent is prohibited.
12. Governing Law
These Terms are regulated by the laws of Spain. Any conflicts will be settled in the courts of Barcelona, Spain.
